Welcome to Divers Cove. Our policies are designed to ensure a safe, fair, and enjoyable experience for every customer. By purchasing equipment, enrolling in training, booking travel, renting equipment, or participating in any Divers Cove activity, you acknowledge that you have read, understood, and agree to the following Policies & Terms of Service.


Equipment Purchases

We stand behind the quality of the equipment we sell and want you to be completely satisfied with your purchase.

Returns

Unused scuba equipment may be returned for a full refund within 30 days of the original purchase date provided:

  • The equipment has never been used or entered the water.

  • The item remains in its original manufacturer's packaging.

  • All manuals, tags, warranty information, accessories, and packaging are included.

  • Original proof of purchase is presented.

Non-Returnable Merchandise

No refunds, exchanges, or store credit will be issued for:

  • Equipment that has been used.

  • Equipment not returned in its original packaging.

  • Items with missing manuals, tags, warranty cards, or accessories.

  • Special order or custom-order products.

  • Clearance or final sale merchandise.

For hygiene reasons, mouthpieces, ear plugs, and other personal-use items are non-returnable.


Special Orders

Special order merchandise requires full payment at the time of purchase.

Special order items are:

  • Non-refundable

  • Non-returnable

  • Non-exchangeable

unless covered under the manufacturer's warranty.


Equipment Service & Repairs

Divers Cove services equipment according to manufacturer specifications.

Estimates

Service estimates are valid for 30 days.

Repairs will not begin until customer approval has been received unless previously authorized.

Replaced Parts

Unless requested prior to service, replaced parts become the property of Divers Cove.

Storage

Equipment not collected within 90 days after notification of completion may be subject to storage fees and may ultimately be considered abandoned property in accordance with applicable Florida law.


Tank Services

Divers Cove offers:

  • Visual Inspections (VIP)

  • Hydrostatic Testing

  • Valve Service & Repair

  • Valve Replacement

  • Air Fills

  • Nitrox Fills

  • Tank Tumbling

  • Oxygen Cleaning

Hydrostatic testing is performed by certified third-party testing facilities.

Completion dates are estimates and may vary.

Divers Cove reserves the right to refuse service or fill any cylinder that:

  • Is out of hydrostatic test.

  • Is out of visual inspection.

  • Appears unsafe or damaged.

  • Does not comply with applicable DOT, CGA, or industry standards.

  • Does not meet oxygen-clean requirements when applicable.

Safety always comes first.


Scuba Training Courses

eLearning

PADI eLearning, Digital Crew Packs, Digital Manuals, and online learning products are non-refundable once assigned or activated, regardless of course completion.


Course Tuition

Course tuition becomes non-refundable once practical training has commenced.

Certification is earned—not purchased.


Rescheduling

Courses may be rescheduled based upon instructor availability.

A $100 rescheduling fee applies when a course is rescheduled within 14 days of the scheduled start date.


Boat Training

Many courses include charter boat dives.

Boat operators require advance reservations and maintain their own cancellation policies.

If a student is unable to participate because of:

  • Illness

  • Injury

  • Late arrival

  • Personal scheduling conflicts

  • Failure to meet course prerequisites

the applicable boat charter fee remains the responsibility of the student.

Boat charters require 72 hours cancellation notice.


Course Completion

Courses must be completed within 90 days (3 months) of enrollment.

Courses not completed within this period will expire.

Continuation beyond 90 days requires re-enrollment at current course pricing.


Certification

Students must successfully complete all knowledge development, confined water, open water, and performance requirements before certification can be issued.

Divers Cove reserves the right to require additional training if performance standards are not met.

Additional instruction may incur additional charges.


Rental Equipment

Rental reservations are:

  • Non-refundable

  • Non-transferable

  • Non-exchangeable

  • Not eligible for store credit

Customers are responsible for lost, stolen, or damaged rental equipment.

Rental equipment must be returned in the same condition in which it was issued.


Air Fill Cards

Air Fill Cards become:

  • Non-refundable

  • Non-transferable

  • Not redeemable for cash

after the first fill has been redeemed.

Unused fills have no cash value.


Gift Cards

Gift Cards:

  • Are valid for 12 months from the date of purchase.

  • Are non-refundable.

  • Are not redeemable for cash.

  • Cannot be replaced if lost or stolen.

  • Any unused balance remaining after the expiration date will be forfeited.


Dive Travel & Expeditions

Divers Cove partners with liveaboards, resorts, charter operators, hotels, airlines, and travel suppliers throughout the world to provide exceptional diving adventures.

Trip payments are forwarded directly to the respective travel suppliers, resorts, charter operators, hotels, and liveaboards in accordance with their payment schedules.

Once payments have been made to the travel supplier, they cannot be recovered or refunded by Divers Cove.


Trip Deposits & Payments

  • All trip deposits and payments are non-refundable.

  • Payments are non-transferable.

  • Payments may not be transferred to another traveler.

  • Payments may not be transferred to another trip.

  • Payments may not be held as future credit.

  • Divers Cove cannot issue refunds once payments have been forwarded to the travel supplier.


Trip Pricing

Unless specifically listed in the trip description:

  • Pricing is based on double occupancy.

  • Single occupancy accommodations may be available upon request and are subject to availability and additional charges.

  • Liveaboard accommodations are based on shared double-occupancy cabins.

  • Cabin assignments are generally made based on gender unless two guests book together and request to share a cabin.


Trip Pricing Does Not Include

Unless specifically listed as included:

  • Airfare

  • Dive accident insurance (DAN or equivalent)

  • Travel insurance

  • Cancel For Any Reason (CFAR) insurance

  • Crew gratuities and tips

  • Marine park fees

  • Port fees

  • Fuel surcharges

  • Nitrox

  • Alcoholic beverages

  • Personal purchases

  • Passport or visa fees

  • Airport transfers

  • Optional excursions

  • Rental equipment

  • Meals or beverages not specifically listed as included


Travel Insurance

Because all trip payments are non-refundable, Divers Cove strongly recommends purchasing comprehensive travel insurance immediately after booking your trip.

For the greatest level of protection, we recommend purchasing a Cancel For Any Reason (CFAR) travel insurance policy whenever available.

We strongly encourage guests not to book a trip unless they are fully committed to traveling or have purchased appropriate travel insurance to protect their investment.

Travel insurance is the traveler's responsibility and is the best way to protect your investment.


Force Majeure

Divers Cove shall not be responsible or liable for cancellations, delays, itinerary changes, schedule modifications, or interruptions resulting from events beyond our reasonable control, including but not limited to:

  • Severe weather

  • Hurricanes or tropical storms

  • Natural disasters

  • Airline delays or cancellations

  • Mechanical failures

  • Government actions or travel restrictions

  • Border closures

  • War or acts of war

  • Terrorism

  • Civil unrest

  • Public health emergencies

  • Epidemics or pandemics

  • Labor strikes

  • Charter operator decisions

  • Port closures

  • Any other event beyond Divers Cove's reasonable control

No refunds or travel credits will be issued by Divers Cove for cancellations or disruptions resulting from these events.


Expedition Itineraries

Dive sites, itineraries, schedules, vessels, accommodations, instructors, and Expedition Leaders are subject to change without notice due to weather, sea conditions, safety considerations, mechanical issues, charter operator decisions, government restrictions, or other operational requirements.

Such changes shall not constitute grounds for cancellation, refund, or credit.


Divers Cove's Role

Divers Cove acts solely as a travel retailer and booking agent for independent travel suppliers, including airlines, resorts, hotels, liveaboards, charter operators, and transportation providers.

Divers Cove is not responsible for the acts, omissions, delays, cancellations, schedule changes, insolvency, or services provided by these independent suppliers.


Medical Requirements

Students and certified divers are responsible for meeting all PADI medical requirements.

If physician approval is required, it must be obtained before participating in any water activities.

Medical conditions do not automatically qualify for refunds or credits.


No-Show Policy

Failure to appear for a scheduled course, private lesson, charter, rental, travel departure, or service appointment without prior notice will result in forfeiture of the applicable fees.

Rescheduling is subject to availability and applicable rescheduling fees.


Photography & Video Release

Divers Cove regularly photographs and records courses, charter dives, expeditions, travel, and special events.

Unless notified in writing prior to participation, you grant Divers Cove permission to photograph and record your likeness for use in:

  • Website

  • Social Media

  • Advertising

  • Marketing

  • Email Communications

  • Printed Publications

  • Educational Materials

No compensation will be provided for the use of these images.


Manufacturer Warranty

Equipment warranties are provided solely by the manufacturer.

Divers Cove will gladly assist customers with warranty claims but cannot guarantee manufacturer warranty approval or replacement decisions.


Pricing

Prices are subject to change without notice.

Divers Cove reserves the right to correct pricing, typographical, inventory, or promotional errors.

Florida sales tax will be added where required by law.


Cash & Credit Card Pricing

Divers Cove offers both:

  • Cash Pricing

  • Credit Card Pricing

Applicable pricing will be displayed at the time of purchase.


Lost & Found

Lost property found at Divers Cove or on affiliated dive boats will be held for 90 days.

Unclaimed items after 90 days may be donated, discarded, or otherwise disposed of.


Customer Satisfaction

Your satisfaction is important to us.

If you have any concerns regarding your purchase, training, equipment, travel, or experience, we encourage you to contact us directly. We are committed to resolving concerns fairly and professionally.


Chargebacks

If a customer initiates a credit card chargeback without first contacting Divers Cove to seek resolution, Divers Cove reserves the right to:

  • Suspend current training or services.

  • Withhold certification processing until the dispute has been resolved.

  • Decline future bookings or purchases.

  • Recover fees and costs associated with the chargeback where permitted by law.


Limitation of Liability

Scuba diving, snorkeling, freediving, boating, and related water activities involve inherent risks that may result in serious injury or death.

All participants acknowledge these risks and agree to participate voluntarily.

Divers Cove shall not be liable for injury, loss, damage, delays, inconvenience, expenses, or interruptions resulting from:

  • Independent travel suppliers

  • Charter operators

  • Liveaboards

  • Resorts

  • Hotels

  • Airlines

  • Weather

  • Mechanical failures

  • Government actions

  • Force majeure events

  • Customer negligence

  • Failure to follow instructor or dive leader instructions


Acceptance of Terms

By purchasing merchandise, enrolling in training, booking travel, renting equipment, participating in an expedition, or utilizing any services offered by Divers Cove, you acknowledge that you have read, understood, and agree to these Policies & Terms of Service.
